Terms of Service

These terms keep things clear between us. They cover how you can use our website, how bookings and payments work, participation in our in-person sessions, and the legal basics that apply when you engage Chakra Hours.

01Acceptance of these terms

These Terms of Service (“Terms”) govern your use of chakrahours.com and the wellbeing programs and services provided by Chakra Hours (“Chakra Hours,” “we,” “us,” or “our”). By using our website or engaging our services, you agree to these Terms. If you are agreeing on behalf of an organization, you confirm that you are authorized to bind that organization.

02Our services

Chakra Hours provides live, human-led workplace wellbeing education, delivered online over Zoom or Microsoft Teams and onsite across the Dallas-Fort Worth metroplex. Offerings include single sessions, class packs, the Year-Round Program, and onsite events. The specific deliverables, dates, and fees for your engagement are set out in your quote, order confirmation, or master services agreement (MSA).

03Educational programming, not medical care

Chakra Hours sessions are educational wellbeing programming. They are not medical care, therapy, psychological treatment, or personalized nutrition or fitness advice, and they are not a substitute for professional care. Participants take part within their own comfort level and should consult a qualified healthcare professional about any medical concern. In an emergency, contact your local emergency services.

04Assumption of risk and release for in-person participation

Our onsite sessions involve physical activity. Depending on the format, this can include yoga and chair yoga, movement and stretching, breathwork, seated and standing meditation, sound baths, and guided walking indoors or outdoors. Some walking sessions are led through wireless headphones, which can reduce your awareness of sounds and activity around you.

By taking part in an in-person session, you agree to the following.

  • Participation is voluntary. You take part within your own ability and comfort level, you may pause or stop at any time, and you may skip anything that does not feel right for you.
  • Physical activity carries inherent risks, including muscle strain, slips, trips, and falls, contact with objects or other people, and, for outdoor walks, uneven ground, weather, and heat. Wearing headphones can add risk by reducing your awareness of your surroundings, so you agree to stay alert and to follow your facilitator’s safety guidance.
  • Our sessions are educational wellbeing programming, not medical care. You should talk with a qualified clinician before taking part if you are pregnant, recovering from an injury or surgery, or living with any heart, respiratory, balance, joint, or other health condition, and you should stop and seek care if you feel pain, dizziness, or distress during a session.
  • To the fullest extent permitted by law, you assume the inherent risks of ordinary participation in our sessions, and you release Chakra Hours from claims for injury or loss arising from those inherent risks and from ordinary negligence. This release does not apply to the extent the law does not allow it, including for gross negligence or willful misconduct, and nothing here limits any right that cannot be waived in advance under applicable law.
  • For onsite events, the host organization and the venue are responsible for the safety and suitability of the premises, including floors, walking routes, equipment, space, and access. The host organization is responsible for sharing relevant safety information with its participants, confirming each participant takes part voluntarily, and arranging any accommodations its participants need.

05Booking, orders, and payment

Prices are quoted in U.S. dollars and may change, except where a fixed price is confirmed in your order or MSA. Online purchases are processed securely through Stripe. For qualifying engagements, invoicing on NET-30 terms is available on request. You are responsible for any applicable taxes. Late payment may pause scheduled sessions until the account is current.

06Packs and the Year-Round Program

Class packs are delivered within the window described in your order. If you upgrade from a class pack to the Year-Round Program within 30 days of completing your pack, we apply 50% of your pack fee as a credit toward your first year.

The Year-Round Program is a 12-month engagement that includes two live 30-minute sessions per month. Here is how billing and cancellation work.

  • Billing is monthly. When you start the program, you authorize us, through our payment processor Stripe, to charge your chosen payment method the monthly fee automatically on each monthly billing date until the program ends or you cancel, plus any applicable taxes.
  • The program runs as a 12-month engagement. Unless your order says otherwise, after the initial 12 months it continues month to month on the same terms until either party ends it.
  • You can cancel at any time by emailing info@chakrahours.com. We will confirm your cancellation. Unless your order or MSA says otherwise, cancellation stops future monthly charges, takes effect at the end of your current billing month, and does not refund the month already in progress. Any minimum-term or early-cancellation terms in a signed order or MSA still apply to that engagement.
  • We will tell you in advance if the monthly fee will change, and a change will not take effect until your next billing month.
  • If you are an individual paying for the Year-Round Program yourself, rather than an organization, you may have extra rights under the automatic-renewal laws of your state, including how you are reminded about renewals and how you cancel. Those rights apply on top of this section, and you can always cancel by emailing info@chakrahours.com.

07Rescheduling, cancellations, and refunds

We know calendars change. Sessions may be rescheduled with reasonable advance notice as described in your order confirmation or MSA. Cancellations made on short notice, and any deposits or fees, are handled according to that written agreement. If we ever need to reschedule a session, we will offer a prompt alternative date or an appropriate credit.

If you buy a class pack online through our website and you do not have a separate written agreement with us, this baseline policy applies.

  • You may request a full refund of an unused pack before your first session, or within 14 days of purchase, whichever comes first. To request one, email us at info@chakrahours.com with your order details.
  • Once your first session has taken place, or after that 14-day window, your pack is non-refundable, but any sessions you have not yet used stay available as a credit toward future Chakra Hours sessions for 12 months from purchase.
  • Individual sessions can be rescheduled with at least 48 hours’ notice. Sessions canceled with less than 48 hours’ notice, or missed without notice, count as used.
  • If we cancel or reschedule a session, you may choose a new date or a credit, and if we cannot offer a reasonable alternative for a session you paid for, we will refund the amount paid for that session.

If you later upgrade an online pack to the Year-Round Program, the 50% pack-to-program upgrade credit described above applies. That upgrade credit is separate from the unused-session credit in this section, and it has its own 30-day window.

08Session recordings

Some formats include an optional session recording. Unless agreed otherwise, recordings are provided to your organization for internal use by your employees and may not be edited, resold, or distributed publicly. Chakra Hours retains ownership of the underlying content and method shown in any recording.

09Intellectual property

The website, its content, our curriculum, materials, and The Workday Reset Method™ are the property of Chakra Hours or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the site and the materials we provide for their intended purpose. You may not copy, reproduce, resell, or create derivative works from our content without our written permission.

10Acceptable use

You agree to use our website and services lawfully, and not to interfere with their operation, attempt to gain unauthorized access, scrape or harvest data, or use them in any way that infringes the rights of others.

11Third-party platforms

Our services rely on third-party platforms, including Zoom, Microsoft Teams, Stripe, and Elfsight. Your use of those platforms is governed by their own terms and privacy policies, and we are not responsible for them.

12Disclaimers

Our website and services are provided “as is” and “as available.” While we deliver our programs with professional care, wellbeing outcomes depend on many factors, and we do not warrant any specific result. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability and fitness for a particular purpose.

13Limitation of liability

To the fullest extent permitted by law, Chakra Hours will not be liable for any indirect, incidental, special, or consequential damages, and our total liability for any claim relating to our website or services will not exceed the amount you paid to us for the service giving rise to the claim.

These limits and exclusions do not apply where the law does not allow them. In particular, nothing in these Terms limits or excludes liability for death or bodily injury caused by our gross negligence or willful misconduct, for fraud, or for any other liability that cannot be limited or excluded under applicable law. If the law in your situation does not allow some of these limits or exclusions, they apply only as far as the law allows.

14Indemnification

You agree to indemnify and hold Chakra Hours harmless from claims, losses, and expenses arising out of your misuse of our website or services, or your breach of these Terms.

15Events outside our control

Sometimes things happen that neither of us can control. These can include severe weather or heat, fire, flood, or other acts of God, venue closures, power, utility, or internet outages, failures of a third-party platform such as Zoom or Microsoft Teams, illness, epidemic or pandemic, labor disruptions, and government actions or restrictions.

If an event like this prevents or delays a session, neither party is liable for the delay or for not performing, and we will work with you in good faith to reschedule the affected session or apply an appropriate credit. This is especially relevant for outdoor walking sessions in the Dallas-Fort Worth area, where heat or weather may require us to move a session indoors, reschedule it, or shorten it for everyone’s safety.

16Resolving disputes

We would rather sort out any problem directly and quickly. Before either of us starts a lawsuit, we agree to first try to resolve the dispute informally.

  • The party with a concern will send a written notice to the other describing the issue and the outcome it wants. You can reach us at info@chakrahours.com, and we will contact you using the details on your account or order.
  • We both agree to work in good faith to resolve the matter for at least 30 days after that notice, including by talking through it together.
  • If we cannot resolve it within 30 days, either party may then pursue the dispute in court.

This informal step does not change the deadline to bring any legal claim, and either party may still seek urgent court relief, for example to protect intellectual property or confidential information, at any time. Any dispute that is not resolved informally is subject to the governing law and venue section below.

17Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction.

18Entire agreement and order of precedence

These Terms, together with your quote, order confirmation, or master services agreement (MSA), make up the entire agreement between you and Chakra Hours about your use of our website and services, and they replace any earlier discussions or understandings on the same topics.

If a signed MSA or order conflicts with these Terms, the signed MSA or order controls for that engagement, to the extent of the conflict. On anything the MSA or order does not cover, these Terms apply.

19General

  • Severability. If any part of these Terms is found to be unenforceable, that part will be limited or removed to the smallest extent needed, and the rest of these Terms will stay in effect.
  • No waiver. If we do not enforce a part of these Terms right away, that does not mean we give up the right to enforce it later.
  • Assignment. We may assign or transfer these Terms, for example as part of a sale, merger, or reorganization of our business. You may not assign or transfer your rights or obligations under these Terms without our written consent, and any attempt to do so without consent has no effect.
  • Notices. We may send you notices by email to the address on your account or order, or by posting them on our website. You can send us notices by email to info@chakrahours.com. Notices are treated as received on the day they are sent by email, or on the day they are posted.

20Accessibility

We want our website and our sessions to work for as many people as possible, and we are always working to make them more accessible. Many of our sessions can be adapted, including seated and lower-intensity options. If you need an accommodation, or you run into a barrier on our website, email us at info@chakrahours.com and we will do our best to help.

21Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “last updated” date above. Your continued use of our website or services after changes take effect means you accept the updated Terms.
